We found no rule that requires an owner to sell through a real estate agent, or that prevents it. The choice changes who does each task and how much you pay, not the legal requirements of the sale. Below, task by task, with the rule that applies (texts reviewed on October 27, 2026).
What changes and what does not
We found no law that requires a license to work as an agent. The Código de Comercio (Commercial Code) says that the profession of corredor (broker) "is free" (article 74), although that rule is written for brokerage between merchants.
Task by task: agent or you
The agent column describes market practice according to two agencies (Xinergia Inmobiliaria, 2021; Mettryc Realty, 2025) and what the Código de Ética (code of ethics) of the Cámara Inmobiliaria de Venezuela, approved on November 12, 2025, asks for. That code binds only the Chamber's members (articles 2 and 43). The rule column cites legal provisions.
| Task | What an agent usually does | What you do if you sell on your own | The rule that applies |
|---|---|---|---|
| Valuation | Estimates a market price. The Código de Ética asks them to advise objectively, including risks and disadvantages (art. 12) | Compare prices of similar properties or commission an appraisal from an appraiser | We found no rule that requires an appraisal for a private sale. See the guide to appraisal and valuation |
| Listing and viewings | Takes photos, publishes the listing, coordinates the viewings and shows the property. A member needs your written authorization to advertise and must be truthful (art. 6) | Publish the listing, deal with interested parties, and coordinate and accompany the viewings | We found no rule that regulates an individual advertising their own property |
| Vetting the buyer | If the agency handles funds, on registering with the ONCDOFT (the anti-money-laundering and terrorism-financing office) it commits to carrying out due diligence on its clients and determining the origin and destination of their funds | Ask for the buyer's identification and ask how they will pay | Circular ONCDOFT-DGCJ 003-2026 (September 8, 2026) names real estate agencies "when they are involved in handling funds", and lawyers and accountants who carry out sales for their clients; it does not mention the owner who sells their own property. The registry note records the RIF (tax ID) of seller and buyer (ISLR, art. 86) |
| The opción de compra-venta (purchase option) | Negotiates price, term and arras (earnest money), and handles the offers. A member must present all offers and counteroffers to you as quickly as possible (art. 17) | Negotiate with the buyer and have a lawyer draft the contract | We found no rule that requires it to be notarized; the Código Civil (Civil Code) treats the document as a means of proof (art. 1.355). If it is notarized, a lawyer must draft it and give it a visado (Ley de Registros y Notarías, the Registries and Notaries Law, arts. 23 and 75). |
| Liens and solvencias | Gathers the paperwork and follows up on the procedures | Process the solvencia municipal, pay the ISLR advance and gather whatever the buyer asks for | The seller self-assesses and pays the advance of 0.5% of the price (ISLR, art. 86), with exceptions. Without that form and the solvencia municipal the sale is not recorded (Ley de Registros y Notarías, art. 97). The Registro certifies the recorded liens (art. 40) |
| The lawyer's visado | Does not replace it: if they are not a lawyer, they cannot give a visado | Hire a lawyer | Mandatory in both cases: every document before the Registries and Notaries must be drafted and given a visado by a lawyer registered with the Instituto de Previsión Social del Abogado, the lawyers' welfare institute (Ley de Registros y Notarías, art. 23) |
| Recording | Coordinates dates with the buyer and the lawyer through to closing | Coordinate with the lawyer and the buyer, and sign | The parties execute the deed before the registrar, who has three business days from submission to record it (Ley de Registros y Notarías, art. 39). An attorney-in-fact needs an express mandate to sell (Código Civil, art. 1.688). See how to record the sale |
| The commission | Charges an agreed percentage or fixed amount. Industry sources cite 5% of the price (Xinergia Inmobiliaria, January 2021) or 3% to 5% (Mettryc Realty, August 2025), usually paid by the seller | Pay no sales commission; you still pay the lawyer and the other costs | We found no law that sets the commission. The Código de Ética requires its members to agree their fees in writing (art. 14). See the guide to the agent's commission |
What the law requires in both cases
If you hire an agent: what to put in writing
The Código de Ética asks its members to agree their fees in writing, with the nature of their services and the method of calculation (art. 14). With an agent who is not a member, you can ask for the same in the contract. It should say:
If you sell on your own: what you take on
Selling without an agent means doing yourself the tasks that do not belong to the lawyer or the Registro: setting the price, advertising and showing the property, negotiating with the buyer and gathering the paperwork in time so that the option does not expire before the sale can be recorded. If the contract says nothing else about the arras, art. 1.263 of the Código Civil allows the party that did not breach, if it does not prefer to demand performance, to keep the arras received or to demand double those it handed over.
Neither you nor an agent can give the document a visado unless you are lawyers. If there are inheritances, powers of attorney, mortgages or a spouse who cannot sign, consult a lawyer before signing the option.
