Paying off the loan extinguishes the debt, but the mortgage stays recorded at the Registro Público (public registry) until its cancellation is recorded, and it will keep appearing on the certificación de gravámenes (lien certificate) your buyer checks.
What a liberación de hipoteca (mortgage release) is and why paying is not enough
A mortgage is a right in rem that follows the property "cualesquiera que sean las manos a que pasen" (whatever hands it passes into) (Código Civil, the Civil Code, article 1.877), and it only has effect if it was registered (article 1.879).
Under article 1.907, it is extinguished by the extinction of the obligation (payment), the loss of the mortgaged property, the creditor's waiver, payment of the price of the mortgaged property, the expiry of its term or the fulfillment of its resolutory condition. Article 1.908 adds prescription.
But the Registro needs a document. When an instrument that extinguishes or waives a right is registered, a nota marginal (marginal note) is placed on the document where that right was created; if that document is in another office, the registrar sends that office an official letter (oficio) (article 1.926). The Ley de Registros y Notarías (Registries and Notaries Law; Gaceta Oficial No. 6.668 Extraordinario, December 16, 2021) says the folio real (property-based record) records charges and encumbrances "y sus respectivas cancelaciones" (and their respective cancellations) (article 35).
That document is the liberación or cancelación de hipoteca (mortgage release or cancellation). Two formal rules:
Who signs: the bank, BANAVIH (the national housing bank) or another creditor
The creditor in whose favor the mortgage was created signs (this appears in the loan document), or whoever replaced it.
Bank with its own funds. Ask the bank. We could not open an official bank page with that procedure; ask at your branch which documents it requires.
Loan with FAOV (the mandatory housing savings fund) funds. A Banesco infographic on mortgages with FAOV (BANAVIH) funds gives these steps:
Loans under the former Ley de Política Habitacional (Housing Policy Law). We did not find an open official source with their procedure; the BANAVIH portal did not load from outside Venezuela on October 27, 2026. Start with the bank that granted the loan, or the one that absorbed it, and ask in whose favor the mortgage is held.
The signed document is submitted to the Registro Público for the jurisdiction of the property, as explained in how to register a sale.
If the bank no longer exists or will not sign
It merged. The company that survives or results from the merger "asumirá los derechos y obligaciones" (will assume the rights and obligations) of those that ceased to exist (Código de Comercio, the Commercial Code, article 346). Ask the absorbing bank for the release.
It was liquidated. In a 2013 court case, the Fondo de Protección Social de los Depósitos Bancarios (FOGADE, the bank deposit protection fund), as liquidator of Banco Federal, submitted to a Caracas court a release document signed by the liquidation coordinators. FOGADE's website announces "Gestión de solicitudes relacionadas con los Bancos en Procesos de Liquidación" (handling of requests related to banks in liquidation proceedings), but on October 27, 2026 the link led to a page under construction.
You still owe something and the creditor will not accept payment. The Código Civil allows you to be released through the ofrecimiento real (formal tender) and deposit (articles 1.306 and 1.307). The Código de Procedimiento Civil (Code of Civil Procedure) regulates the procedure (articles 819 to 825): the offer is made through a judge, the money is deposited in a bank and, if the judge declares the offer and the deposit valid, the debtor is released from the day of the deposit.
You already paid and nobody signs. We did not find in the Código Civil or in the Ley de Registros y Notarías a procedure for the registrar to cancel the mortgage on their own. What remains is to sue so that a court declares it extinguished, by payment or by prescription, through the ordinary procedure if there is no special one (Código de Procedimiento Civil, article 338). The Ley de Registros y Notarías requires annotation of the judgments, decrees and precautionary measures in which the extinction of a right in rem over a property is sought (article 45). For this you need a lawyer.
Does the mortgage prescribe?
Yes, but it does not disappear from the Registro on its own. Under article 1.908 of the Código Civil, if the property is still in the debtor's hands, the mortgage prescribes when the debt prescribes; if it is in a third party's hands, it prescribes after twenty years. Personal actions prescribe after ten years, unless the law provides otherwise (article 1.977).
Three limits:
How much it costs to record the cancellation
Municipal tax: not payable. Article 91 of the Ley de Registros y Notarías taxes sales and the creation of mortgages in favor of the municipality, and article 93 excludes "la cancelación de hipotecas" (the cancellation of mortgages).
SAREN (the national registries and notaries service) fees. Numeral 7 of article 83 (0.50%, 1% or 2% depending on the value) mentions the "constitución de hipotecas" (creation of mortgages), not their cancellation. SAREN Providencia No. 001 (administrative order; Gaceta Oficial No. 42.301, January 20, 2022), on Registro Público fees, has no line item for the release either. There is no published official source saying which items the registry charges to record it. The fees are in petros and as of October 27, 2026 no replacement unit has been published: ask for the calculation in writing.
Exemptions.
How it appears on the certificación de gravámenes
Once the release is recorded, the mortgage document carries the marginal note and, where the folio real applies, the folio real records the cancellation. Before selling, ask for a certificación de gravámenes covering the period from the year the mortgage was created; the fee is charged for each year reviewed (Providencia 001, article 5, numeral 2).
If the mortgage appears without a cancellation note, for the Registro it is still in force and it passes with the property to whoever buys it (article 1.877). Release it before selling, or agree that the buyer takes on paying it as part of the price, a case the Ley de Registros y Notarías provides for when calculating the municipal tax on the sale (article 92).
